Terms & Conditions
1. Booking & Payment
A booking is considered confirmed once the required booking fee has been paid and the client has agreed to these Terms & Conditions.
By booking a session, the client confirms that they have read and agreed to these Terms & Conditions.
2. Photography Style
Wee Wild Folk Photography has its own photography and editing style. The photographer chooses how the photos are taken, selected and edited, including colours, posing, retouching and the overall final look. Client preferences can be discussed before the session, but the final images remain the photographer’s creative work.
3. Copyright & Ownership
Copyright in photographs is dealt with in accordance with the Copyright Act 1994 and any specific agreement between the photographer and client.
Unless otherwise agreed in writing, the client receives a personal use licence to download, print and share their delivered photographs.
The client does not receive the original RAW files or unedited photographs.
The client may not sell, license, commercially exploit or otherwise use the photographs for commercial purposes without the photographer's written permission.
For commercial use, please contact Wee Wild Folk Photography to discuss a separate licence.
4. Editing & Altering Images
The photographs delivered by Wee Wild Folk Photography are professionally edited final images and represent the photographer's finished artistic work.
To protect the integrity of the photographer's work, clients agree not to apply filters, presets or other colour changes, significantly alter, retouch, recolour or otherwise edit the delivered photographs without the photographer's prior permission.
This includes editing through:
- TikTok
- Lightroom
- Photoshop
- Canva
- phone editing apps
- other photo-editing applications.
Minor cropping required by a social-media platform or automatic compression by a social-media platform is permitted.
If you would like an image adjusted in a different way, please contact the photographer. Where possible, the photographer will be happy to discuss an alternative edit.
Please note: This clause is intended to protect the photographer's artistic work and does not remove any rights that cannot legally be excluded under New Zealand law.
5. Image Selection
The photographer will provide the client with a proof gallery of selected images, which may include more images than are included in the client’s chosen package. These images will be watermarked and are provided for selection purposes only.
The client may choose their favourite images up to the number included in their chosen package. Only the selected images included in the package will be fully edited and delivered.
6. Gallery
The completed gallery will be delivered electronically.
Once the gallery has been delivered and received, the client is responsible for downloading and safely storing their photographs. The photographer recommends keeping at least one backup copy of all downloaded images.
The photographer cannot guarantee permanent storage or continued access to galleries or images after the gallery has been delivered to the client.
7.Image Sharing & Permission
After the client has received their completed gallery, the photographer may ask for permission to share selected images on social media, the photographer’s website, portfolio or for promotional purposes.
The client is free to say no. Permission will always be requested after the gallery has been delivered, and the client’s response in our written conversation will serve as a record of their consent or refusal.
No images will be shared for promotional purposes without the client’s permission.
8. Image Quality & Printing
Photographs are edited for digital viewing and professional printing.
Colours can appear differently depending on the screen, device, printer and printing service used.
The photographer cannot guarantee the colour or quality of prints produced by third party printing services.
9. Rescheduling
If the client needs to reschedule, reasonable notice is requested.
Where possible, the session will be moved to another mutually suitable date.
Weather related rescheduling is at the photographer's discretion, particularly for outdoor sessions.
The photographer will make reasonable efforts to choose a suitable alternative date where weather conditions are unsuitable for the session.
10. Cancellation
If the client cancels their session, the booking fee is non-refundable.
If the client has paid more than the booking fee, the remaining amount will be refunded.
These terms do not affect any rights the client has under New Zealand consumer law.
11. Photographer Cancellation
If Wee Wild Folk Photography needs to cancel a session due to illness, emergency or circumstances outside the photographer's reasonable control, the photographer will make reasonable efforts to reschedule the session.
If rescheduling is not possible, any amount paid for the photography service that has not been provided will be refunded.
12. Client Responsibility
The client is responsible for informing the photographer of any relevant information that may affect the session.
The client is also responsible for the supervision and safety of children attending the session.
The photographer will take reasonable care during the session but cannot be responsible for accidents, injuries or loss caused by circumstances outside the photographer's reasonable control.
13. Artistic Style & Retouching
Normal editing is included in the chosen package.
The photographer does not provide extensive retouching or alterations outside their normal editing style.
This includes major body alterations, extensive skin retouching, removal of objects, or significant changes to clothing or backgrounds.
The photographer's standard editing style is applied to all final images.
14. Force Majeure / Circumstances Outside Our Control
The photographer will not be responsible for failure to provide the service where circumstances outside their reasonable control prevent the session from taking place, including severe weather, natural disasters, venue closures, government restrictions or serious emergencies.
Where reasonably possible, the photographer will offer an alternative date.
15. Privacy
Personal information provided during the booking process will be handled in accordance with applicable New Zealand privacy law.
Information will only be collected and used for purposes reasonably connected with providing the photography service, communicating with clients and managing bookings.
16. Changes to These Terms
Wee Wild Folk Photography may update these Terms & Conditions from time to time.
The Terms & Conditions that apply to a booking are those that the client agreed to at the time of booking, unless otherwise agreed.
17. Agreement
By completing a booking, the client confirms that they have read, understood and agreed to these Terms & Conditions.
